The rezoning request for 1233 South Third Street, a 2.16-acre largely forested property with a former single-family home, was brought forward by the owner, Whitt Real Estate, LLC represented by Jenny W. Whitt. The request aimed to change the zoning from R20 (minimum 20,000 SF lots) to R12 (minimum 12,000 SF lots).

The Council carefully considered the drainage issues highlighted by the City Engineer Franz Holt.

This current condition is a big impediment to the drainage for the downstream property.

Whitt acknowledged these concerns, confirming that the developer, whether herself or a future buyer, would be responsible for rectifying the drainage problems and installing the necessary water and sewer taps.

Council Member Montrena W. Hadley expressed concerns about clearly communicating the drainage improvement requirements to any future property owner, stating:

The Council also sought clarity on the proposed lot dimensions, with Ms. Whitt confirming that each lot would be about 70’ wide at the road frontage and about 200’ deep - 0.34 acres per lot.

Barbara Mooney, a resident of 1237 Sky View Drive, raised a question regarding property access from Third Street. The question was satisfactorily addressed by explaining the recombination plat that provided the necessary frontage.

Council Member Sean Ewing supported the rezoning, contingent upon the inclusion of Council Member Hadley's amendment.

Ultimately, the Council unanimously approved the rezoning request, with the conditions and drainage improvement requirements to be clearly delineated in the approval letter.

This rezoning decision paves the way for the potential development of six single-family lots, pending the completion of the stipulated drainage improvements and infrastructure requirements by the current or future property owner.
